Bank Robbery

Federal Bank Robbery
Title 18 U.S.C. sec. 2113

When being sentenced in federal court there are factors contained in the Federal Sentencing Guidelines which can aggravate or mitigate the actual sentence imposed. Below are the statutory maximums which the court must consider when imposing a sentence.

Class C Felony
Possible sentence: Not more than 20 years in prison with a supervised release term of at least 2 years and not more than 3 years following release from prison.
A person can be charged with Bank Robbery if any of the following applies:
1) Whoever, by force and violence, or by intimidation , takes, or attempts to take, from the person or presence of another, or obtains or attempts to obtain by extortion any property or money or any other thing of value belonging to, or in the care, custody, control, management, or possession of, any bank, credit union, or any savings and loan association; or,

2) Enters or attempts to enter any bank, credit union, or any savings and loan association, or any building used in whole or in part as a bank, credit union, or as a savings and loan association, with intent to commit in such bank, credit union, or in such savings and loan association, or building, or part thereof, so used, any felony affecting such bank, credit union, or such savings and loan association and in violation of any statute of the United States, or any larceny.

NOTE: If force, violence or intimidation is NOT used during the course of the bank robbery and the amount taken is $1,000 for more, the maximum sentence is 10 years in prison.
NOTE: If force, violence or intimidation is NOT used during the course of the bank robbery and the amount is less than $1,000, the maximum sentence is not more than 1 year.

Class B felony
Possible sentence: Not more than 25 years in prison with a supervised release term of at least 3 years and not more than 5 years following release from prison.
A person can be charged with the Class B felony of Bank Robbery if any of the following applies:
Whoever, in committing, or in attempting to commit, an offense described above, assaults any person, or puts in jeopardy the life of any person by the use of a dangerous weapon or device.

Class A felony
Possible sentence: Life imprisonment without possibility of parole OR the death penalty.
A person can be charged with Class A felony of Bank Robbery if any of the following applies:
During the course of the robbery, or in avoiding or attempting to avoid apprehension for the commission of such offense, or in freeing himself/herself from arrest or confinement for such offense a death results.
