Colorado’s Home Defense Law

Colorado’s Make My Day law, C.R.S. 18-1-704.5, gives gun-owning homeowners the right to shoot an intruder in self-defense if they believe that the intruder was there to commit a crime using physical force, however slight. This legislation was created in 1985, giving homeowners immunity if they shoot an intruder even if the intruder dies. Because of this law, you can fight charges of assault or manslaughter with regard to an intruder. How Does the Make My Day Law Work in Colorado?

The Make My Day laws gives legal immunity to gun owners who shoot and kill an intruder in self-defense. The shooter must have reason to believe that the intruder was going to use physical force to commit a crime. Physical force can involve a weapon, or in this case, even as little as fists.

The Make My Day law applies only to the actual physical house, so front and back yards or front porches are not included. There is no duty to retreat with the Make My Day law. In addition, any occupant of a dwelling may use the Make My Day law as defense, so long as he or she is protecting the property and/or other occupants within it from the physical force of the intruder.

Deadly force is not legally allowed for any other type of property protection other than your home in Colorado, with the exception of use to prevent a criminal from committing first-degree arson.
