What Constitutes Sexual Assault?

Colorado law classifies sex crimes into 3 categories: sexual assault, sexual contact, and sexual assault on a child. Sexual assault (penetration or intrusion) includes rape, forced oral copulation, and penetration with a foreign object. Sexual contact (touching), on the other hand, could include sexual battery, groping, and fondling. Assault on a child occurs when the alleged victim of sexual assault is under 15 years of age and the perpetrator is at least four years older.

Note that the age of consent in Colorado is 17. When the alleged victim is 17 or older, the main issues in a sexual assault case are:

  • whether a sexual act took place, and
  • whether the alleged victim knowingly and willingly consented to it.

    Penalties following Conviction

    Sexual assault is considered a felony in Colorado and could carry significant fines and state prison time. If you have been convicted of sexual assault, the penalties can include:

    • a fine of up to $750,000, and
    • 4-12 years in a Colorado prison.

    Penalties can increase due to aggravating factors. Aggravating factors include:

    • the plaintiff was under 14 years of age,
    • the defendant was aided in the crime by another person,
    • the plaintiff suffered serious bodily injury,
    • the defendant used, or threatened to use, a deadly weapon,
    • the defendant has a history of violent crime, or
    • the plaintiff was pregnant.

    These aggravating factors can increase your sentencing to 24 years or more in prison, as well as fines of up to $1,000,000.

    In addition to jail time and fines, those convicted of felony sexual assault crimes in Colorado are also required to register as sex offenders, where their names will be entered into the Colorado Bureau of Investigation’s felony sex offender registry. Names will not be included on the registry if the person was convicted as a juvenile or the crime was a misdemeanor.

    Failure to register as a sex offender in Colorado is a Class 6 felony, and penalties can include a fine of $1,000-$100,000 and/or 1-1.5 years in prison.

    Under certain circumstances, you may petition to have your name removed from the registry if it has been 20 years since your offense and you have not been convicted of another sex crime during that period.
